PARKING OPERATION. Parking talcs, hours and methods of operation, free parking, <br />ifany discounts and allo~~~~ances shall be determined and directed in ~~~riting by Owner to <br />the Bidder. The Bidder ~~-ill make the City Garage a~~ailable at the direction of O~~~ner for <br />Special cent use. <br />TAXF,S AND ASSESSMENTS. The Bidder shall not be responsible for the payment of <br />any taxes and assessments ]e~~icd upon or assessed ~t~ith respect to the real and personal <br />property contained in or upon the Cara*es. <br />LIABILITY INSLRANCE AND INDEMNIFICATION. The Bidder shall insure, <br />indemnify and hold O~~ner, its agents and employees. harmless a~~ainst any and all <br />liability and loss ~~~hatsoe~~cr arisin~~ fi~<~m any damage. injury. claim ~~r demand caused by <br />the acts, misconduct errors. omissions or negligence of the Bidder and its agents or <br />employees during the scope and course of their contract pertaining to the Garages. <br />The Bidder shall pro~~ide and pay for comprchensi~c general liability insurance, property <br />damage insurance and garage I:eeper~s Ic~~al liabilit} insw<mce [o a combined single limit <br />of (hie Million Dollars ($1.000.000.00) and statuton co~~~ra~~c for ~~orlcer~s <br />compensation insurance. The Bidder shall ha~~c the right to be self insured for such <br />co~~eragc and limits as are permitted or npproced by the State of Indiana for the Bidder <br />from time to time. O~~mer shall be named as an additional insured under the insurance <br />policy or policies pro~~ided above. <br />O~s~ner shall indemnify and hold the Bidder harmless against any and all liability and loss <br />~~hatsoc~cr arising from any damage. injury. claim or demand caused by the design or <br />structural condition of the Garages. or use or tenanc~~ of the location. <br />SECLRITI'. The Bidder shall exercise reasonable efforts to procidc for the general <br />security of autonu~biles in the Garages and shall exercise reasonable effort to notify <br />Owner of any dangerous situations in the Garages. The Bidder shall not ha~~e any duty to <br />pro~~ide a guard se~~ice or other security scr~-ice in connection with the operation of the <br />Gara~cs. <br />INDEPENDENT CONTRACTOR. O~~~ner and the Bidder are not to be deemed as <br />partners or joint ~~cntures, and that the scr~~ices to be rendered by the Bidder arc as an <br />independent contractor. All personnel for the management of the Gara~~es shall be <br />employees of the Bidder and not of the O~~~ner. <br />NON-DISCR1~111NAT1O1. The Bidder shall not discriminate a~~ainst any e~uploye~ or <br />applicant for employment to be employed in pcrtormance of the management of the <br />Garages ~~~ith respect to his or her hire, tenure. term conditions or ~~ri~~ileges of <br />employment or anv other matter directly or indirectly related to employment because of <br />his or her race. color. rcli~~ion. sex. handicap. national on<~in or ancestry. <br />BID EFALCA"PION. The Raic~elopmcnt Commission shall c~~aluate and consider the <br />follo~zing factors in its re~~ie~~ of C3ids: <br />
