comply with any notice served upon such person pursuant to <br />Section 16 -36 of this Ordinance shall constitute a violation of <br />this Ordinance and each day's failure, neglect or refusal shall <br />constitute a separate offense. <br />It is hereby declared that the permitting or allowing to <br />remain on any lot, place or area or upon the sidewalks or alley- <br />ways abutting the same any weeds, grass, or deleterious unhealthful <br />growths over 12 inches high or other noxious matter shall constitute <br />a public nuisance. <br />SECTION 4. Penalty. <br />Chapter 16, Article 4, Section 38 of the Municipal Code of <br />the City of South Bend, Indiana is amended so as to read as <br />follows: any occupant, tenant, owner, or agent of such owner of <br />any lot, place or area within the City of South Bend, Indiana who <br />violates any provision of this Article, after due notice is given <br />pursuant to Section 16 -36 of this Ordinance and fails to remove <br />weeds, grass or deleterious unhealthful growths over 12 inches <br />high or other noxious matter that may be growing, lying or located <br />within any such lot, place or area, or upon the sidewalks or alley- <br />ways abutting the same on conviction thereof shall be fined for <br />each offense not less than $20.00 nor more than $300.00.
