to the CNG fueling station construction Project contemplated by the Interlocal <br />Agreement, is a sound investment for the City. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of <br />South Bend, Indiana, as follows: <br />SECTION I. The proposed Interlocal Agreement attached hereto and <br />incorporated herein as Exhibit A is hereby and in all ways approved, and upon its <br />signature by the Mayor of South Bend, and approval by the fiscal body of TRANSPO, it <br />shall be filed with the Mayor of South Bend and with the St. Joseph County Auditor. <br />SECTION II. The sum of Nine Hundred Seventy-Two Thousand Five Hundred <br />Dollars ($972,500) is hereby appropriated from and set aside within County Option <br />Income Tax (COIT) Fund 4404 for City's required contribution to the costs of <br />participating in the construction of a Compressed Natural Gas (CNG) fueling station and <br />facility at 1401 South Lafayette Boulevard, South Bend, Indiana, pursuant to the <br />Interlocal Agreement between the City and the South Bend Public Transportation <br />Corporation ( TRANSPO) which is Exhibit A hereto. <br />SECTION III. Pursuant to Ind. Code 36 -1 -7 -11.5, the appropriated sum shall be <br />paid to TRANSPO per the terms and conditions of the Interlocal Agreement (Exhibit A). <br />SECTION IV.
