BLOUGH <br />CRY CLERK, SOUTH BEND, 1ND. <br />ORDINANCE NO, ,,Q,,s_ 6 <br />AN ORDINANCE REGULATING THE PUBLIC DISPOSAL OF <br />GARBAGE AND RUBBISH ON ANY LAND WHICH IS SITUATED <br />WITHIN THE CORPORATE LIMITS OF THE CITY OF <br />SOUTH BEND, INDIANA, REQUIRING PERMITS AND LICENSES <br />AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF. <br />BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND , <br />INDIANA: <br />SECTION I. PURPOSES: <br />WHEREAS, there now does not exist in the City of South Bend, Indiana, <br />sufficient regulation_ of the public disposal of garbage and rubbish <br />and, <br />WHEREAS, the proper regulation and disposal of garbage and refuse <br />Affects the public health, morals and welfare, it is hereby <br />determined that an Ordinance regulating the same be adopted. <br />SECTION II. DEFINITIONS: <br />The following definitions shall apply in the interpretation and <br />enforcement of this Ordinance. <br />(a) Board of Health The term "Board of Health" shall mean the <br />St. Joseph County Board of Health. <br />(b) Health Department "Health Department" shall mean the St.Joseph <br />County Health Department. <br />(c) Health Officer The term "Health Officer" shall mean the Health <br />Officer of the St. Joseph County Health Department and /or his <br />authorized representatives. <br />(d) Person The term 11Person" shall include cities, villages, <br />townships, counties, and other governmental agencies, corporations <br />and both municipal and private associations, partnerships, <br />individuals and authorities. <br />(e) Ground Water The term "Ground Water" shall mean any supply <br />of water beneath the undisturbed surface of the earth in any <br />natural geologic formation. <br />(f) Surface Water "Surface Water" shall mean any body of water <br />whose top surface is exposed to daylight including flowing bodies <br />as well as ponds and lakes. <br />
