AILED IN CMN 7s OFFICE ORDINANCE NO. 4777 -65 KATI -IRYN L. PLOUGH CITY CLERK, SOUTH BEND, IND. AN ORDINANCE FOR ADDITIONAL APPROPRIATIONS FROM THE MOTOR VEHICLE HIGHWAY FUND IN THE AMOUNTS OF $80,050.00 TO THE STREET AND ALLEY MATERIALS ACCOUNT 5 -421 AND $194,950.00 TO A SPECIAL STREET CONSTRUCTION ACCOUNT. WHE=AS, Certain extraordinary conditions have developed since the adoption of the existing annual budget so that it is now necessary to appropriate more money than was appropriated in the annual budget for the various functions of the City Government, because of the payment to the City of a sum of money from and out of the Motor Vehicle Highway distribution by the State of Indiana which was greater than the anticipated revenue from said source. BE IT ORDAINED, by the Common Council of the City of South Bend, Indiana: SECTION I. That for the expenses of City Government and its institutions for the year ending December 31, 1965, the following sums of money are hereby appropriated and set apart out of the fund herein named and for the purpose herein spec- ified, subject to the laws governing the same and such sums herein appropriated shall be held to include all expenditures authorized to be made during the year, unless, otherwise ex- pressly stipulated and provided by law. SECTION II. That for said fiscal year there is hereby appropriated out of the Motor Vehicle Highway Fund hereinafter designated, the following specified amounts to meet extraordinary expenditures as follows: 1. From the Motor Vehicle Highway Fund to Account S -421 "Street and Alley Materials" the sum of $80,050.00, said appro- priation to be limited to the purchase of materials for the construction or re- construction of streets, roads and thorough- fares, and 2. From the Motor Vehicle Highway Fund to the Special Street Construction Account the sum of $194,950.00, said sum to be administered by the City Engineer for Contractual Services for the construction or re- construction of streets, roads and thoroughfares. SECTION III. This ordinance shall be in full force and effect from and after its passage by the Common Council, its approval by the Mayor, legal publication and the fulfillment of all statutory requirements of emergency appropriations.
