BLOUGH <br />CITY CLERK, SOUTH BEND, IND. <br />ORDINANCE NO. 4859 -66 <br />AN ORDINANCE AUTHORIZING THE PURCHASE OF <br />LAND BY THE CITY OF SOUTH BEND, INDIANA, <br />WHEREIN THE PURCHASE PRICE EXCEEDS THE <br />SUM OF $2,000.00. <br />BE IT ORDAINED BY THE CO2011ON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA: <br />WHEREAS, the City of South Bend, Indiana has a long range <br />established plan for the construction, widening and extension of <br />streets and highways within the City Limits and, <br />WHEREAS, from time to time it will become necessary to obtain rights <br />of way in order to accomplish the over all purposes, plans, and <br />responsibilities of the City of South Bend, Indiana, and, <br />WHEREAS, as a part of the plan referred to it is contemplated that <br />the City will in the foreseeable future, extend the length of <br />Chapin Street in the City of South Bend, Northwardly and across <br />what is now privately owned property and, <br />WHEREAS, a certain parcel of said real estate, now privately owned, <br />which lies in the right of way path, may be purchased for the sum <br />of $12,000.00 and, <br />WHEREAS, said purchase price is fair and reasonable and it is to <br />the best advantage of the City to purchase said right of way site <br />at this time. <br />NOW THEREFORE, BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF <br />SOUTH BEND, INDIANA: <br />SECTION I. That the purchase by the City of south Bend, Indiana <br />for the sum of $12,000.00, of the following described real estate <br />situate in the County of St. Joseph, City of South Bend, Indiana, <br />to -wit: <br />A part of Bank Out Lot No. 34 of the first Plat of <br />Out Lots of the Town, now City of South Bend, <br />bounded and described as follows, to -wit: <br />Beginning at the Northeast corner of said Lot; <br />thence running West on the North line thereof <br />100 feet; thence South 150 feet; thence East <br />100 feet to the East line of said lot; thence <br />North along the East line thereof 150 feet to <br />the place of beginning. <br />is authorized by the Common Council of the City of South Bend, <br />Indiana, pursuant to the authority contained in the Acts of the <br />
