<br />ORDINANCE NO. ~ Z ~ ~ -O <br />A SECOND SUBSTITUTE ORDINANCE FIXING THE ANNUAL PAY AND <br />MONETARY FRINGE BENEFITS FOR MEMBERS OF THE SOUTH BEND POLICE <br />DEPARTMENT FOR CALENDAR YEARS 2002, 2003, 2004 AND 2005 <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council recognizes that Indiana Code § 36-8-3-3(d) provides that the "annual <br />compensation of all members of the police department and other appointees shall be fixed by <br />ordinance of the legislative body before August 20"' of each year for the ensuing budget year". <br />A salary ordinance fixing annual pay and fringe benefits for members of the South Bend <br />Police Department was enacted in 1997 for a period of four years ending December 31, 2001, i.e. <br />Ordinance No. 8808-97. As of the filing date of this Substitute Ordinance, the following provisions <br />incorporate the recommended annual pay and monetary fringe benefits for sworn members of the <br />South Bend Police Department for calendar years 2002, 2003, 2004 and 2005. <br />Accordingly, this Ordinance is in the best interest of the City, the South Bend Police <br />Department, and citizens of South Bend, Indiana. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South <br />Bend, Indiana, as follows: <br />Section I. Designation of Officers: <br />During the 2001 Police negotiations, the City of South Bend recognized the F.O.P. <br />Bargaining Committee of the Fraternal Order of Police, Lodge No. 36, as its sole bargaining unit for <br />the negotiation of annual pay and monetary fringe benefits for sworn members of the South Bend <br />Police Department, excluding the Police Chief, Division Chiefs, and Captains. In light of the fact <br />that ratification by the Lodge has not been achieved as of this filing, this recognition is solely for <br />annual pay and monetary fringe benefits for calendar year 2002 for such sworn members. <br />Pursuant toI.C. 36-8-1-12, the Police Chief, Division Chiefs and Captains ofthe South Bend <br />Police Department are designated in this Ordinance as "Officers". <br />Page 1 of 6 <br />
