ORDINANCE NO. ~ Z ~ ~ -O A SECOND SUBSTITUTE ORDINANCE FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS FOR MEMBERS OF THE SOUTH BEND POLICE DEPARTMENT FOR CALENDAR YEARS 2002, 2003, 2004 AND 2005 STATEMENT OF PURPOSE AND INTENT The Common Council recognizes that Indiana Code § 36-8-3-3(d) provides that the "annual compensation of all members of the police department and other appointees shall be fixed by ordinance of the legislative body before August 20"' of each year for the ensuing budget year". A salary ordinance fixing annual pay and fringe benefits for members of the South Bend Police Department was enacted in 1997 for a period of four years ending December 31, 2001, i.e. Ordinance No. 8808-97. As of the filing date of this Substitute Ordinance, the following provisions incorporate the recommended annual pay and monetary fringe benefits for sworn members of the South Bend Police Department for calendar years 2002, 2003, 2004 and 2005. Accordingly, this Ordinance is in the best interest of the City, the South Bend Police Department, and citizens of South Bend, Indiana. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: Section I. Designation of Officers: During the 2001 Police negotiations, the City of South Bend recognized the F.O.P. Bargaining Committee of the Fraternal Order of Police, Lodge No. 36, as its sole bargaining unit for the negotiation of annual pay and monetary fringe benefits for sworn members of the South Bend Police Department, excluding the Police Chief, Division Chiefs, and Captains. In light of the fact that ratification by the Lodge has not been achieved as of this filing, this recognition is solely for annual pay and monetary fringe benefits for calendar year 2002 for such sworn members. Pursuant toI.C. 36-8-1-12, the Police Chief, Division Chiefs and Captains ofthe South Bend Police Department are designated in this Ordinance as "Officers". Page 1 of 6
