BLOUGH PUBLIC INTEREST TO ACQUIRE THE MASS TRANS - <br />NTH BEND, INM PORTATION SYSTEM OF NORTHERN INDIANA <br />TRANSIT, INC., WHICH SHALL BE A DISTINCT <br />MUNICIPAL CORPORATION AND WHICH SHALL BE <br />KNOWN AS 11THE SOUTH BEND PUBLIC TRANSPORTATION <br />CORPORATION" AND DEFINING THE CORPORATE <br />LIMITS OF SAID CORPORATION. <br />WHEREAS, heretofore on the 23rd day of January, 1967, Northern <br />Indiana Transit, Inc., an Indiana corporation, and operators <br />of the mass transportation system in the City of South Bend, <br />Indiana, filed their request with the Common Council of this <br />City asking that the Council determine among other things <br />whether it is in the public interest for the public to acquire <br />the system and, <br />WHEREAS, Northern Indiana Transit, Inc., is of the opinion, <br />by virtue of said request, that public acquisition of the system <br />is necessary to enable the system to render adequate service <br />within the City and, <br />WHEREAS, thereafter the Common Council caused to be made studies <br />to determine whether it is in the public interest to the <br />public to acquire the system and, <br />WHEREAS, as a result of such studies it is the solemn judgment <br />of the Common Council that public acquisition of the system is <br />necessary to enable the system to render adequate service within <br />the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA: <br />SECTION I. The establishment and maintenance of an urban mass <br />transportation system is necessary to the welfare of the general <br />public in that it expands the economy and social opportunities <br />available to the residents of the City and benefits those who, <br />for economic reasons, reasons of health, reasons of age and <br />demonstrated unfitness to operate a motor vehicle cannot <br />freely move about except through the services rendered by an <br />urban mass transportation system. <br />SECTION II. That there is hereby created a municipal corporation <br />which shall be known as "South Bend Public Transportation <br />Corporation" for the purpose of acquiring the mass transportation <br />system of Northern Indiana Transit, Inc., pursuant to the <br />authority contained in the acts of the Indiana General Assembly <br />for 1965, chapter 337. <br />SECTION III. That said corporation shall have a Board of <br />Directors consisting of five in number. <br />SECTION IV. That the corporate boundaries of the South Bend <br />Public Transportation Corporation shall coincide with and be <br />identical to the corporate boundaries of the Civil City of <br />
