ORDINANCE NO. / <br />AN ORDINANCE AMENDING SECTION 40 -17 <br />OF THE MUNICIPAL CODE OF THE CITY OF <br />SOUTH BEND, INDIANAs 1962, AS <br />AMENDED, ALSO KNOWN AS SECTION 4 OF <br />ORDINANCE NO. 3702, THE ZONING <br />ORDINANCE OF THE CITY OF SOUTH BEND, <br />INDIANA, AS AMENDED <br />FILED IN CLERK'S OFFICE <br />NOV 2 31966 <br />KATHRYN L. BLOUGH <br />CITY CLERK, SOUTH BEND, IND. <br />BE IT ORDAINED BY THE COMP40N COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA: <br />Section 1: <br />That Section 40 -17 of the Municipal Code of the City of <br />South Bend, Indiana, 1962 as amended, also known as Section 4 <br />of Ordinance No. 3702, the Zoning Ordinance of the City of <br />South Bend, Indiana, as amended, is hereby amended by the <br />addition thereto of the following sub - section: <br />(9) Principal offices of attorneys, architects, <br />accountants, realtors, engineers and insurance agents, provided <br />no name plate exceeding one square foot in area is used or <br />exhibited. <br />However, except in cases where the subject property has <br />been rezoned under the provisions of Section 40 -8 (Section 23) <br />of this ordinance, such use(s) shall only be permitted if so <br />authorized by the Board of Zoning Appeals as specified in <br />Article IV (Section 18) of this ordinance. A petition filed <br />before the Board under the provisions of this paragraph (9) <br />shall include a development plan for the property showing its <br />location, site improvements, traffic circulation pattern, and <br />any other essential improvements contemplated. In the event <br />the Board does approve the petition, the approval shall be <br />subject to the development plan as approved by <br />the Board of Zoning Appeals and such plan shall constitute a <br />limitation on the use of the property. <br />Section 2: <br />IM &2nd READING This Ordinance shall be in full force and effect from <br />COMMITTEE OF THE WHOLE <br />and after its enactment, approval by the Mayor and legal <br />PUBLIC HEARING I --I --1-t- <br />3rd READING /- q.42PUblication. <br />NOT APPROVED <br />REFERRED A ber of the Common Co ncil <br />r .0 1_9.tp� o e City of South Bend, Indiana <br />
