ORDINANCE NO. 4981 -68 <br />FILED IN CLERK'S OFFICE <br />:N'1 8 1968 <br />KATHRYN L. <br />CITY CLERK, SOUTH B -N", iND, <br />AN ORDINANCE DEFINING FALSE FIRE ALARMS; <br />PROVIDING A PENALTY FOR MAKING SAID FALSE <br />FIRE ALARMS; PROVIDING A CASH REWARD TO ANYONE <br />FURNISHING INFORMATION LEADING TO THE ARREST <br />AND CONVICTION OF A PERSON OR PERSONS MAKING SAID <br />FALSE FIRE ALARMS; REPEALING ANY ORDINANCES <br />IN CONFLICT THEREWITH; AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, false fire alarms tend to create public <br />disturbances, endanger life and property, and create considerable <br />and undue expense; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, THAT: <br />Section 1. It shall be unlawful for anyone to <br />willfully turn in, or report a false fire alarm or false fire <br />call. <br />Section 2. For the purpose of this ordinance, a <br />false fire alarm or false fire call is defined as a summons or <br />request, made in person, by telephone, or by any other means, to <br />the proper authorities of the Municipal City of South Bend, for <br />the dispatching of firemen and fire fighting equipment to the <br />scene of a fire which, in fact, does not exist, or as the <br />reporting of a fire which, in fact, does not exist. <br />Section 3. Any person convicted of willfully turning <br />in or reporting a false fire alarm or false fire call shall be <br />fined not less than Twenty Five ($25.00) Dollars nor more than <br />Three Hundred ($300.00) Dollars or by imprisonment for not less <br />than ten (10) days nor more than six (6) months or by both <br />said fine and imprisonment; provided however, that such fine <br />shall not be less than the actual cost sustained by the City <br />of South Bend in responding to such false fire alarm or false <br />fire call. <br />Section 4. The City does hereby offer a reward <br />of Fifty ($50.00) Dollars to be paid to any person furnishing <br />information leading to the arrest and conviction of anyone <br />giving a false fire alarm or false fire call as defined by <br />this ordinance. <br />Section 5. Any ordinances in conflict with this ordinance <br />are hereby repealed. <br />Section 6.
