Dosmann 2076-01 Location: 1317 Lincolnway West City of South Bend STAFF REPORT July 9, 2001 REQUESTED ACTION: The petitioners are requesting a zone change from "C" Commercial, "D" Height and Area to "A" Residential, "D" Height and Area to allow single-family residential. EXISTING LAND USE: The property currently contains a residential structure. SURROUNDING LAND USE AND ZONING: Located to the north are single-family homes zoned "A" Residential, "B" height and area; to the east are single-family homes zoned "C" Commercial, "D" height and area; to the south across Lincolnway West is a church and a commercial business zoned "C" Commercial, "D" height and area; and to the west is a commercial business zoned "C" Commercial, "D" height and area. ACCESS: Access to the site is from Lincolnway West. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has not been addressed by the petitioner. SITE DATA: The total site to be rezoned is 4,370 square feet. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, flood hazards, wetlands or environmental hazard areas are present. SITE PLAN: A site plan is not required for rezonings to "A" Residential. AGENCY COMMENTS• PRELIMINARY STAFF RECOMMENDATION: Based on information available prior to the public hearing, the staff recommends that this petition be sent to the Common Council with a favorable recommendation. The proposed rezoning to "A" Residential, "D" height and area represents a downzoning, and will be more compatible with residential housing to the north and east than the commercial uses that could be developed under the existing "C" Commercial zoning. The proposed zoning and use is also consistent with the land use and zoning plans that are being formulated by the - Land Use and Appearance Subcommittee of the Lincolnway West Steering Committee.
