29 <br />SECTION 18. <br />Board of Zoning Appeals <br />a. A Board of Zoning Appeals is hereby established. <br />The Board shall consist of five (5) members to be appointed <br />by the Mayor as provided in Section 68, Chapter 174, of the <br />Indiana Acts of 1947. <br />b. The Building <br />Commissioner shall forthwith transmit to the Board all the <br />papers constituting the record upon which the action appealed <br />from was taken. <br />d. Jurisdiction: In specific cases the Board of Zoning <br />Appeals may authorize by permit a variation of the applica- <br />tion of the use, height and area district regulations, herein <br />established in harmony with their general purpose and intent <br />as follows: <br />(1) Permit a temporary building for commerce or <br />industry in a residence district which is incidental <br />to the residential development, such permit to be issued <br />for a period of not more than one (1) year. <br />- (2) Permit the continuance of a legal nonconforming <br />use existing at the time of the passage of this ordinance <br />that has ceased for a period of one (1) year; provided <br />the owner of the building or premises devoted to said <br />use can show proof that the intent was not to discontinue <br />the nonconforming use of said building or premises. <br />
