DEROSE <br />CITYATTORNEY October 2, 2001 CHIEFASSISTANTCITYATTORNEY <br />Ms. Charlotte Pfeifer <br />President, South Bend Common Council <br />4`'' Floor County-City Building <br />South Bend, IN 46601 <br />Re: An Ordinance Appropriating Additional Funds From Hall of Fame Operations Fund # 677 and <br />From Hall of Fame Fund #377 <br />Dear Ms. Pfeifer: <br />On September 10, 2001, the South Bend Common Council approved Ordinance #9258-01 <br />which appropriated $484,088.97 from the College Football Hall of Fame Operations Fund (#677) and <br />an additional $442,198.00 from Hall of Fame Fund (#377). Both appropriations were for the purpose <br />of paying the City's contractual obligation to the National Football Foundation. The Council was <br />provided with a copy of the National Football Foundation contract with the City. <br />It has come to our attention that the Ordinance which the Council approved and passed on <br />September 10, 2001 was not the final, intended version of the Ordinance. Our Department had been <br />working on the National Football Foundation appropriations ordinance since early July, but due to the <br />delay in securing NFF approval for the contract, additional time passed and the original figures were <br />no longer valid. Ordinance 9258-01 contained the original figures and was the version filed for first <br />reading. We believe we replaced it with a revised version. However, the Clerk's office has no record <br />of the replacement. The error is regrettable, and frankly, we are not certain how it occurred. The <br />result, however, is that an additional appropriation for the Hall of Fame is now required. <br />Accordingly, the attached ordinance serves to appropriate an additional $3,763.09 from the <br />Hall of Fame Operations Fund (#677) and an additional $122,802.00 from College Football Hall of <br />Fame Fund (#377). <br />We regret any inconvenience to the Common Council which may be caused by the mixup. We <br />will make every effort to assure that this does not occur again. Either Thomas Skarbek or Liz Rowe <br />from the Controller's Office will make the necessary presentation to the Council on this matter and <br />-will answer any questions that you may have. <br />Aladean M.
