the expertise to determine the maximum amount of performance bonds <br />and the average processing expenses which should be required under <br />the Unsafe Building Act. <br />SECTION I. Chapter 6, Article 8, Section 6-37, of the South <br />Bend Municipal Code shall be, and hereby is, amended to read as <br />follows: <br />Sec. 6-37. Property Maintenance Code. <br /> <br />(b) Additions, modifications and deletions. The provisions of the <br />2000 Edition of the International Property Maintenance Code, <br />adopted by subsection (a) shall be modified, added to or deleted so <br />that the following articles, sections or subsections shall read as <br />follows: <br /> <br />(8) Sections 305, 306.3, 306.4 and 306.5 shall be deleted in <br />their entirety. <br />(8.1) Section 404.1 shall be modified to read in its entirety <br />as follows: Privacy. Dwelling units hotel units rooming units <br />and dormitory units shall be arranged to provide privacv~and be <br />separate from public areas or commons areas or any other ad~oinina <br />spaces. ' <br />(8.2) Section 404.4.1 shall be modified to read in its <br />entirety as follows: Prohibited occupancy Kitchens living rooms <br />dlnina rooms, other public or common areas and nonhabitable spaces <br />shall not be used for sleeping purposes <br />(9) Section 602.3 shall be modified to read in its entirety <br />as follows: Heat Supply: Every owner and operator of any building <br />who rents, leases or lets one or more dwelling unit, rooming unit, <br />dormitory or guestroom on terms, either expressed or implied, to <br />furnish heat to the occupants thereof shall supply heat to maintain <br />a temperature of not less than 68° F (20° C) in all habitable <br />rooms, bathrooms, and toilet rooms. <br />Exception: When the outdoor temperature is below the winter <br />outdoor design temperature for the locality, maintenance of the <br />minimum room temperature shall not be required provided that the <br />heating system is operating at its full design capacity. The <br />winter outdoor design temperature for the locality shall be as <br />indicated in Appendix D of the International Plumbing Code. <br /> <br />
