Notre Dame Gift Property <br />ORDINANCE NO. 5046 -68 <br />AN ORDINANCE PROVIDING FOR THE RECEIVING AND <br />CONVEYING OF A GIFT OF REAL PROPERTY TO THE <br />CITY OF SOUTH BEND, INDIANA <br />WHEREAS, the University of Notre Dame is the owner of a certain <br />parcel of real estate on Notre Dame Avenue on which real estate abandoned <br />Fire State No. 7 is situated, and <br />WHEREAS, said University of Notre Dame desires to make a gift of <br />the aforesaid real estate to the City of South Bend for the purpose of <br />establishing and maintaining a neighborhood center to enable City of South <br />Bend to render social service to the residents of the City, and <br />WHEREAS, the Common Councilcf the City of South Bend is author- <br />ised to enact ordinances by the Acts of 1905, Chapter 129, Section 53, <br />Clause 6, as shown in Burns Section 48-1407 to receive gifts, donations, <br />bequests, and public trusts and to agree on terms and conditions accompa- <br />nying same; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA: <br />That the City of South Bend, Indiana, accept a gift of real pro- <br />perty from University of Notre Dame, being that property more particularly <br />described as follows, to -wit: <br />The east one hundred and sixty -five (165) by eighty -two and <br />one -half (82z) feet of Lot Number twenty -three (23) in Sorin's <br />First Addition, as shown by plat in the records of St. Joseph <br />County, said premises being more specifically described as <br />one hundred and sixty -five (165) feet in length from east to <br />west, and eighty -two and one -half (82-) feet in width from <br />north to south, and fronting east on Notre Dame Avenue, <br />by a Deed of Conveyance, subject to taxes, assessments, and restrictions <br />of record, for the use and purpose of establishing and maintaining a neigh- <br />borhood center to enable said City to render social services to the resi- <br />dents of the City. <br />This ordinance shall be in full force and effect from and after <br />its passage by the Common Council of the City of South Bend ,approval by the <br />Mayor, and compliance with all statutory requirements. <br />M& 2nd READINS 10 -14 -68 <br />OIMMTTTEE OF THE WHOLE <br />MUD HEARING 10 -28 -68 <br />3rd READING 10 -28 -68 <br />NIT APPROVED <br />REFERRED <br />PASSED 10 -28 -68 <br />of the Common Council <br />AILED IN CLERK'S 6FF SCE <br />KATHRYN L.
