Return to: <br />South Bend Redevelopment Commission <br />1400 S County -City Building <br />South Bend, Indiana 46601 <br />CERTIFICATE OF COMPLETION <br />The City of South Bend, Indiana, Redevelopment Commission ( "Commission') certifies <br />that on September 13, 2004, by Quit Claim Deed ( "Deed ") recorded on September 15, 2004, as <br />Document Number 0445524 in the Office of the Recorder of St. Joseph County, Indiana, it <br />conveyed to James and Sandra McCune ( "Developer ") the following described real estate <br />( "Property ") in the City of South Bend, St. Joseph County, Indiana: <br />Lots Numbered Forty -five (45) through Forty -Seven (47) and the South <br />Half of lot Numbered Forty -eight (48) as shown on the recorded Plat of South <br />Bend City, a part of the City of South Bend, together with the West Half of the <br />vacated alley lying East and adjacent to said lots. <br />Pursuant to the covenants, conditions, restrictions and provisions of a Contract for Sale of <br />Land for Private Development entered into by and between the Commission and the Developer <br />( "Contract ") dated August 20, 2004, and recorded on August 23, 2004, as Document Number <br />0441618 in the Office of the Recorder of St. Joseph County, Indiana, the Developer undertook to <br />complete certain improvements on the Property conveyed by the Deed. The Developer has fully <br />completed the improvements on the Property in accordance with the provisions of the Contract. <br />This Certificate is issued January 16, 2014, and is evidence of the satisfaction and <br />termination of the following covenants in the Contract and in the Deed: <br />neither the Commission nor any other party shall hereafter have or be entitled to <br />exercise any rights, remedies, or controls otherwise available with respect to the <br />Property as a result of a default in or breach of any provisions of the Contract or <br />the Deed by the Developer or any successor in interest or assign, unless: <br />a. the Developer, any lessee, or any other successor in interest or assign <br />defaults or breaches the covenants of Section VII (A)(2) of the Contract <br />and <br />b. the right, remedy or control relates to such default or breach. <br />
