ORDINANCE NO. 3 Z~ f~~-- AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, CORRECTING A TECHNICAL ERROR IN ORDINANCE 9314-02 WHICH ADOPTS THE ST. JOSEPH COUNTY HEALTH DEPARTMENT WELLHEAD PROTECTION ORDINANCE STATEMENT OF PURPOSE AND INTENT On March 25, 2002 the South Bend Common Council adopted Ordinance Number 9314-02 which codified the St. Joseph County Health Department Wellhead Protection Ordinance (#103-98) in the South Bend Municipal Code in a new Article 5, Section 17-47.1 It has now come to the Council's attention that the Section numbering in Ordinance Number 9314-02 is incorrect and that the correct Section number of the Wellhead Protection Ordinance should be Article 5, Section 17- 48.1. This Ordinance corrects this technical numbering error. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. Ordinance Number 9314-02 which adopts the St. 3oseph County Health Department Wellhead Protection Ordinance and which incorporates it at Chapter 17, Article 5, Section 17-47.1 is hereby corrected to reflect that the new Section number shall be 17-48.1, and not Section 17-47.1. Section II. All references to Section 17-47.1 of the South Bend Municipal Code contained in Ordinance 9314-02 are hereby corrected to reflect the correct Section number of 17-48.1; with all other provisions in Ordinance Number 9314-02 not amended by this ordinance remaining in full force and effect. Section III. This Ordinance shall be in full force and effect from and after its passage by the Common Council, and approval by the Mayor. Member, South Bend Commo Council 1st READING S` ~3 -oZ.
