(a) Upon the impoundment of an animal, a reasonable attempt shall be made to notify and inform the owner of the <br />animal of the requirements of this article for regaining the custody of the animal. <br />(b) Such attempt shall include, but not necessarily be limited to, the following: <br />(1) In the instance of an impounded dog or cat, contact with the owner identified by the microchip or other permanent <br />means of identification, if any, borne by the dog or cat; <br />(2) In the instance of an impounded dog or cat not bearing a permanent means of identification, contact with the <br />veterinarian facility listed on the animal's vaccination tag; and <br />(3) Cooperation of effort with other governmental and private agencies, such as the Humane Society of St. Joseph <br />County or other humane and/or breed rescue organizations recognized by the animal care and control division. <br />(c) Any owned, free-roaming cat who lacks visible owner identification will be processed through the community cat <br />program.? Any ear tipped community cat that has been spayed/neutered and vaccinated as described in Section 5.001 <br />of this chapter will be processed through the community cat program. <br /> <br />5.1072 Redemption <br />(f) A person may reclaim an animal in the custody of the Department of Animal Control upon providing the following: <br />(1.)Proof of ownership, and <br /> <br />(2.)Payment of redemption fee and any other service/medical fees, as approved by the Director. <br /> <br />(3.)It shall be mandatory that any dog or cat not displaying a current city pet registration or current identification <br /> <br />tag if not a city resident, affixed to its collar, after the effective date of Ordinance XXXXXX , passed t.b.d., upon <br />its redemption by its owner, and prior to its release by the Department of Animal Control, be implanted with a <br />microchip and registered for purposes of identification and recovery. The cost for this process shall be at the <br />owner's expense before the animal's release. <br />(4.)All animals shall be registered with the city prior to release, or require enforcement action to mandate <br /> <br />registration. <br />(g) Stray or at-large animals will be held three business days at the Department of Animal Control. <br />(h) Unclaimed animals become the property of the Department of Animal Control and may be placed for adoption, <br />transferred to rescue or humanely euthanized, pursuant to § 5.090. <br />(i) An animal that has been previously impounded stray or at-large and is now being redeemed for the second or <br />subsequent redemption, will be required to be spayed or neutered by a licensed veterinarian at the owner's <br />expense. Arrangements to perform the procedure must be made within 24 hours of reclaim and enforcement action <br />pending spay/neuter completion will be issued at the time of reclaim. <br />(j) In cases mandating spaying or neutering of a dog(should we include cats?), the dog may be transported directly to the <br />veterinarian of the owner's choice at the city's discretion for completion of the surgery and pickup of the animal by the <br />owner from the veterinarian after such completion. <br />(Ord. XXXXXX) <br /> <br />§ 5.108 INSPECTIONS. <br />(a) Whenever it is necessary to make an inspection to enforce any of the provisions of or perform any duty imposed by <br />this chapter or when there is reasonable cause to believe that there exists in any building or upon any premises any <br />violation of the provisions of this chapter or state law, the Animal Control Officer or Health Officer or police officer is <br />authorized at all reasonable times to inspect the same for compliance with the provisions of this chapter or any state <br />law; provided that: <br />(1.)If the property is occupied, the officer shall first present proper credentials to the occupant and request entry, <br /> <br />explaining the reasons therefor; and <br />(2.)If the property is unoccupied, the officer shall make a reasonable effort to locate the owner or other persons <br /> <br />having control of the property and request entry explaining the reasons therefor. <br /> <br />
