<br />A RESOLUTION OF THE COMMON COUNCIL OF THE
<br />CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN
<br />THE CITY OF SOUTH BEND, INDIANA, COMMONLY KNOWN AS
<br />736 CALIFORNIA, 908 -910, 9069 838,836-8349 824 -8269 812, and 808
<br />PORTAGE AVENUE
<br />AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF UP TO A
<br />(6) SIX -YEAR REAL PROPERTY
<br />TAX ABATEMENT FOR
<br />NEAR NORTHWEST NEIGHBORHOOD, INC.
<br />WHEREAS, a petition for real property tax abatement has been filed with the City Clerk
<br />for consideration by the Common Council of the City of South Bend, Indiana, requesting that the
<br />area commonly known as 908 -910 Portage Avenue, 906 Portage Avenue, 736 California, 838
<br />Portage Avenue, 836 -834 Portage Avenue, 824 -826 Portage Avenue, 812 Portage Avenue, and
<br />808 Portage Avenue, South Bend, Indiana, and which is more particularly described as follows:
<br />That part of the Northeast and Southeast Quarters of Section 2, Township 37 North, Range 2
<br />East, Portage Township, City of South Bend, St. Joseph County, Indiana which is described as:
<br />Lots # 113, # 114, # 115 and Lot # 112 of the Plat of "Shetterley Place 3`d Plat" now a part of the
<br />City of South Bend as recorded in Plat Book # 5, on Page # 60 in the records of the St. Joseph
<br />County, Indiana Recorder's office, excepting the East 35 feet of said Lot # 112, Lot "A", Lot #
<br />33, all of Lots # 34, Lot # 35, Lot # 36, Lot # 37 of the Plat of "Shetterley Place 2 "d Plat" to the
<br />City of South Bend as recorded in Plat Book # 5 on Page # 44 in the records of said Recorder's
<br />office, and Lot # 7 of the Plat of "C.E. Smith's Subdivision of Lots Numbered 38, 39,40 & 41 of
<br />Shetterley Place 2nd Plat, addition to the City of South Bend: as recorded in Plat Book # 10 on
<br />Page # 10 in the records of said Recorder's office.
<br />Containing 1.76 acres more or less.
<br />and which has Key Numbers 018 - 1060 -2535, 018 -1060 -2536, 018 - 1062 -2658, 018- 1059 -2488,
<br />018 -1059 -2489, 018 -1059 -2491, 018 - 1059 -2492, and 018 - 1059 -2505 at this point and time, be
<br />designated as an Economic Revitalization Area under the provisions of Indiana Code § 6 -1.1-
<br />12.1 et seq., and South Bend Municipal Code Sections 2 -76 et sue., and;
<br />WHEREAS, the Department of Community Investment has concluded an investigation
<br />and prepared a report with information sufficient for the Common Council to determine that the
<br />area qualifies as an Economic Revitalization Area under Indiana Code § 6 -1.1 -12.1, et seq., and
<br />South Bend Municipal Code Sections 2 -76, et seq., and has further prepared maps and plats
