ORDINANCE NO. 13 2- Z ` Q <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA AMENDING ARTICLE 6, SECTION 17-49 OF THE SOUTH BEND <br />MUNICIPAL CODE TO DELETE SHUTOFF VALVE REPAIR <br />STATEMENT OF PURPOSE AND INTENT <br />Article 6, Section 17-49 of the South Bend Municipal Code imposes a service charge of <br />$1.50 per month for all water users which is then deposited into the Water Leak Insurance Fund <br />(#644). This Code Section originally applied the service charge revenue to costs for repair ofwater <br />service lines, and not to shutoff valves. Use of the service charge revenue for repair and replacement <br />ofwater shutoff valves was added by amendment to Section 17-49 in the 1980's. Elimination of <br />water shutoff valve replacement and service costs from the Water Leak Insurance Fund will stabilize <br />the Water Leak Insurance Fund established by Article 6, Section 17-49 and prevent an increase in <br />rates because the cost of repairing and replacing water shutoff valves has increased and placed <br />financial strain on the Water Leak Insurance Fund. The water shutoff valve repair/replacement costs <br />can be absorbed by and paid through the Water Works Operations Fund (#620) as they were done <br />in the past. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South <br />Bend as follows: <br />Section I. Article 6, Section 17-49 of the South Bend Municipal Code shall be and is <br />amended to read as follows <br />Sec.17-49. Assessment of charges; deposit in separate fund, purpose. <br />(a) The sum of one dollar and fifty cents ($1.50) per month shall be added to the <br />water service charge of all water users. <br />(b) All of said sums of money so collected shall be deposited in a separate fund of <br />the Bureau of Water Works and said fund shall be used solely for the repair and/or <br />replacement of leaking water service lines <br />Section II.
