WHEREAS, there was enacted during the 1969 Session of the
<br />Indiana General Assembly an Act, Chapter 392 of the Acts of 1969,
<br />making available to cities, towns and counties for engineering,
<br />construction or reconstruction of roads, streets and bridges
<br />under local jurisdiction, certain additional funds to be derived
<br />from the 7th and 8th cents of Indiana motor fuel tax and fuel
<br />use tax and from increases in fees levied under the Motor Vehicle
<br />Act; and
<br />WHEREAS, no appropriation of such funds was included in
<br />the regular 1970 budget for the Civil City of South Bend; and
<br />WHEREAS, under the terms of the said Chapter 392 of the
<br />Acts of 1969, it is necessary for the City of South Bend to
<br />appropriate from other funds available to it an amount equal to
<br />not less than one - fourth of the cost of eligible projects under
<br />said Chapter 392; and
<br />WHEREAS, an emergency exists requiring the appropriation
<br />and expenditure of certain of said funds already received or to
<br />be received before the end of the year 1970.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
<br />CITY OF SOUTH BEND, INDIANA:
<br />SECTION I. The following sums of money are hereby appro-
<br />priated and ordered set apart out of the Local Road and Street
<br />Fund for engineering, construction and reconstruction of roads,
<br />streets and bridges, eligible for assistance under Chapter 392
<br />of the Acts of 1969, under the jurisdiction of the Civil City of
<br />South Bend, Indiana, as follows:

<br />$67,660.00
<br />SECTION II. The following sums of money are hereby appro-
<br />priated and ordered set apart out of the Cumulative Capital Imp-
<br />rovement Fund as the balance of the City of South Bend's share
<br />of the cost of engineering, construction and reconstruction of
<br />roads, streets and bridges referred to in Section I as follows

<br />$22,553.00
<br />SECTION III. This ordinance shall be in full force and
<br />effect from and after its passage and approval as required by law.
