ORDINANCE NO . ~ ~ ~ O - O AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: The first street to be vacated is Schulman Drive (formerly Davis Drive) from Olive Street to Grant Street for a distance of 1,067.6 feet and a width of 60 feet. The second street to be vacated is Grant Street from Sample Street to the North line of the Indiana Northern Railway Company right of way. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property.. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: Legal Description: The first street to be vacated is Schulman Drive (formerly Davis Drive) from Olive Street to Grant Street for a distance of 1,067.6 feet and a width of 60 feet and being more particularly described as a part of the Northeast Quarter of Section 15, Township 37 North, Range 2 East, Portage Township, City of South Bend, Joseph County, Indiana, and described as follows: Commencing at North Quarter Corner of Section 15, Township 37 North, Range 2 East, said point also being on the centerline of Olive Street; thence South along said centerline of Olive Street, 1,326 feet; thence East 30 feet to the East right of way line of Olive Street and the North right of way line of Schulman Drive (formerly Davis Drive), and the place of beginning; thence continuing East along said North line of Schulman Drive 1,067.6 feet to the West right of way line of Grant Street; thence South 60 feet to the South right of way line of Schulman Drive; thence West along said South line of Schulman Drive, 1,065.15 feet to the East right of way line of Olive Street; thence North 60 feet to the place of beginning.
