R. 23 & Vaness Turtle Creek Apts. and Kroger Store ORDINANCE N0, 5131 -69 AN ORDINANCE AMENDING SECTION 40 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1962, AS AMENDED, ALSO KNOWN AS ORDINANCE NO. 4990, THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED., AS AMENDED. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1: That Section 40 of the Municipal Code of the City of South Bend, Indiana, 1962, as amended, also known as Ordinance No. 4990, the Zoning Ordinance of the City of South Bend, Indiana, be and the same is hereby amended as follows, to wit: The following described real estate situated in the City of South Bend, Indiana and annexed to the City as part of Ordinance No. 5084 -69 be and the same hereby is zoned "B" Residential Use and "A" Height and Area District, conforming to the site development plan attached hereto: Part of the Southwest Quarter of the Southeast Quarter Section 31, Township 38 North, Range 3 East, St. Joseph County, Indiana, more particularly described as follows: Beginning at a point on the North line of the said Southwest Quarter of Southeast Quarter of Section 31, 450.80 feet East of the North- west corner thereof; thence North 89 degrees 54 minutes 40 seconds East along said North line a distance of 738.24 feet to a point; thence South 34 degrees 32 minutes 40 seconds West, a distance of 275.18 feet to a point; thence South 55 degrees 27 minutes-20 seconds East, a distance of 20 feet to a point; thence South 34 degrees 32 minutes 40 seconds West, a distance of 155.17 feet to a point; thence South 55 degrees 27 minutes 20 seconds East a distance of 170 feet to a point; thence South 34 degrees 32 minutes 40 seconds West, a distance of 327.35 feet to a point; thence South 55 degrees 27 minutes 20 seconds East, a distance of 130.00 feet to the Westerly line of Indiana State Road 23 (Edwards- s burg Highway); thence South 34 degrees 32 minutes a� 40 seconds West along said Westerly line of said o Highway a distance of 50 feet to a point; thence North 55 degrees 27 minutes 20 seconds West a C00 distance of 131.55 feet to a point; thence South 1st & 2nd READING // - /o -69 34 degrees 32 minutes 40 seconds West a distance � COMMITTEE OF THE WHOLE of 108.30 feet to a point; thence North 00 degrees c'2 PUBLIC HEARING 12 -8 -69 e 3rd READING 12 -8 -69 NOT APPROVED r� ...
