ZONING & ANNEXATION DECEMBER 16, 2013 4:50 P.M. <br />Committee Members Present: Dr. Fred Ferlic (4:57), Oliver Davis (4:58), Henry Davis, <br />Gavin Ferlic (AB) <br />Other Council Present: Tim Scott, Valerie Schey, Dr. David Varner, Karen White, <br />Derek Dieter <br />Citizen Members Present: Kyle Chamberlin (AB), Marcus Ellison (AB) <br />Others Present: Christa Hill, Richard Nusbaum, Tim Sexton, Mike Danch, Tony <br />Zappia, Justin Ferris <br />Agenda: Bill 62 -13 Rezone 605, 613, 617, 621 Notre Dame & 823 Sorin <br />The Zoning & Annexation Committee chaired by Dr. Fred Ferlic had but one bill set for hearing that being <br />a petition to rezone a parcel at the NW corner of Sorin and Notre Dame Avenue. <br />Though there was not a quorum for the beginning of the hearing Oliver Davis arrived in due course <br />allowing a vote to recommend to full Council. <br />The presentation of the rezoning request was made by attorney Tony Zappia representing an <br />Indianapolis developer. Tony outlined the protracted development of the parcel. Conceived first as a <br />condo project, partially built, then abandoned, the boarded incomplete buildings sat vacant for several <br />years. <br />Only after extensive meetings orchestrated by the City which included the neighborhood organization, <br />Notre Dame, the banks and the developer did the project re- emerge as an apartment project geared to <br />graduate students as well as professionals. To better control the self- imposed restrictions on the <br />occupancy of the complex it was determined that a Planned Unit Develop (PUD) plan be requested. This <br />approach, it was said, would afford the surrounding neighborhood better assurances than an open <br />student apartment approach. <br />Representatives from Notre Dame, the City, the neighborhood, and the developer were all present to <br />answer questions. <br />Specific questions by Valerie Schey and Oliver Davis concerning civil law partners were answered. <br />Assurances were made they would not be discriminated against. <br />
