ORDINANCE NO. 5233 -70 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CIVIL CITY OF SOUTH BEND AND THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT FOR THE CONVEYANCE OF TWO PARCELS OF REAL ESTATE LOCATED IN THE CITY OF SOUTH BEND AND OWNED BY THE CIVIL CITY OF SOUTH BEND WHEREAS, the Civil City of South Bend is the owner of the two hereinafter described parcels of real estate, the first of which was formerly used and occupied by the Water Works of the City of South Bend and the second of which was formerly used and occupied by the Civil City of South Bend as a city hall and parking lot, and WHEREAS, said real estate is no longer needed by the City of South Bend for its purposes, and WHEREAS, said parcels of real estate were included in the Urban Renewal Plan approved by the Common Council of the City of South Bend on the 9th day of September, 1968, as land donations to be made by the City of South Bend for non cash credits to the Department of Redevelopment, and WHEREAS, the Civil City of South Bend and the City of South Bend Department of Redevelopment entered into an agreement dated the 8th day of September, 1970, wherein the Civil City of South Bend agreed to convey legal title to said parcels of real estate to the City of South Bend Department of Redevelopment for the purpose of obtaining non cash credits to the City of South Bend Department of Redevelopment in the total sum of $263,712.00 from the Department of Housing and Urban Development, said sum being the appraised value of said real estate as deter- mined by three appraisers duly appointed by the Judge of the Circuit Court of St. Joseph County, Indiana, to appraise said parcels of real estate, and WHEREAS, the Civil City of South Bend is empowered to make a conveyance for the purposes herein set forth to the City of South Bend Department of Redevelopment pursuant to the pro- visions of the Acts of the Indiana General Assembly of 1957, ch. 229 SlAsamended, and the Acts of the Indiana General Assembly of 1905, ch. 129 §53, NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana: SECTION I. That an Agreement dated the 8th day of September, 1970, entered into between the Civil City of South Bend and the City of South Bend Department of Redevelopment for the conveyance by the Civil City of South Bend to the City of South Bend Department of Redevelopment of certain real estate for the purpose of obtaining non cash credits to the City of South Bend in the total sum of . $263,712.00 from the Department of Housing and Urban Development is hereby approved and confirmed; said real estate being located in the City of South Bend, County of St. Joseph, State of Indiana, being described as follows:
