ORDINANCE NO. 5302 -71 <br />AN ORDINANCE AMENDING CHAPTER 40, SECTION 40 -14 OF THE <br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1963, <br />ALSO KNOWN AS ORDINANCE NO. 3702 AS AMENDED, THE ZONING <br />ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. <br />BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA: <br />SECTION 1. That Chapter 40, Section 40 -14 of the Muni- <br />cipal Code of the city of South Bend, Indiana, adopted by the Com- <br />mon Council of the city of South Bend, Indiana, on the 14th day <br />of October, 1963, and more commonly known as the Zoning Ordinance <br />of the city of South Bend, Indiana, be amended by the reclassifi- <br />cation and rezoning of a certain parcel of land in the city of <br />South Bend, St. Joseph County, Indiana, more particularly described <br />as follows, subject to site plan attached hereto. <br />Beginning at a point on the westerly line of now vacated <br />Cherry Street which is directly west of the northwest <br />corner of Lot Numbered 29 as shown on the recorded Plat <br />of John F. Kirby's Subdivision of a part of Bank Out <br />Lot Numbered 83 of the Second Plat of Out Lots of the <br />Town, now City, of South Bend, Indiana, platted by the <br />State Bank of Indiana; thence southerly along the said <br />west line of now vacated Cherry Street to a point di- <br />rectly west of the northwest corner of Lot Numbered 37 <br />in said Subdivision; thence East along the north line of <br />said Lot Numbered 37 to the northeast corner of said Lot; <br />thence north a distance of 66 feet to the southeast cor- <br />ner of Lot Numbered 32 in said Subdivision; thence north <br />along the east lines of Lots Numbered 32, 31, 30 and 29 <br />of said Subdivision to the northeast corner of Lot Num- <br />bered 29 in said Subdivision; thence west along the <br />north line of said Lot Numbered 29 to the northwest cor- <br />ner thereof; thence west to the place of beginning, all <br />in the City of South Bend, Indiana, <br />from "A" Residential district and "A" Height and Area district <br />to "E" Heavy Industrial district and "F" Height and Area district, <br />subject to site plan attached hereto. <br />
