Section 3. Any person violating any of the provisions of this <br />ordinance shall become liable to the City for any expense, loss, or <br />damage occasioned by the City by reason of such violation. <br />ARTICLE IX -- Variances <br />Section 1. Any person, upon written application to the City <br />Engineer's office within ninety (90) days after the effective date of this <br />ordinance, who shows, in the case of the activity being conducted or <br />operated, that compliance with Article V of this ordinance would either <br />be impossible or constitute an undue hardship because of time limita- <br />tions, may be granted a variance by the Board of Public Works and <br />Safety for a reasonable time, not to extend beyond two (2) years from the <br />effective date of this ordinance, as amended, at which date all variances <br />shall terminate and after which date no new variances will be granted. <br />Any variance may be granted on the condition that the person receiving it <br />shall submit plans for the installation of preliminary treatment facilities <br />to the City Engineer within six (6) months from the date of the granting of <br />the variance and shall make reports to the City Engineer periodically as <br />to the progress being made toward compliance with Article V of this <br />ordinance. A variance shall not be granted under the provisions of this <br />Section where the person applying therefor is causing a public nuisance <br />or other injury to the general public, and any such variances shown to <br />have been granted under these circumstances shall be immediately termin- <br />ated. Any variance granted under the provisions of this Section shall not <br />be construed to relieve the person who shall receive it from any liability <br />or penalties imposed by other laws for the commission or maintenance <br />of a nuisance. <br />ARTICLE X -- Validity <br />Section 1. No statement contained in this ordinance shall be <br />construed as being amendatory to or taking precedence over the pro- <br />visions of Ordinance No. 3964 fixing the schedule of rates and charges <br />- Page 14 - <br />
