ORDINANCE NO. <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, SETTING THE MAXIMUM ANNUAL SALARY FOR THE CITY CLERK FOR <br />CALENDAR YEAR 2009 <br />Statement of Purpose and Intent <br />The City Clerk serves as Clerk of the Common Council under Indiana Code § 36 -4 -6 -9 <br />and maintains custody of its records. The City Clerk is also charged with maintaining all records <br />as required by law; keeping the city seal; administering oaths; taking depositions; attending all <br />regular and special meetings of the Council; and performing other duties as required by the <br />Common Council. <br />The Common Council is required by under Indiana Code § 36 -4 -7 -2 to fix the annual <br />compensation of all elected city officers, with such an ordinance being published at least thirty <br />(30) days before final action by the Council. <br />Indiana Code § 36- 4 -11 -4 authorizes the City Clerk to appoint "the number of deputies <br />and employees authorized by the city legislative body ". In the interest of fairness, the following <br />ordinance sets forth the same percentage increase for the City Clerk as requested for the deputies <br />and employees in the City Clerk's Office. <br />C4 lo't a 0 /7-/ 4 honk ra by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />Section I. The annual compensation for the City Clerk of the City of South Bend, <br />Indiana, shall be established at a maximum amount of $52,800.00 for the 2009 calendar year. <br />Section II.
