(574) 233 -1171 Fax (574) 237 -1125 www.btlaw.com August 13, 2008 Re: University of Notre Dame du Lac, Innovation Park at Notre Dame, Inc. and Future Tenants (collectively, the "Petitioner ") /Application for Real Property Tax Abatement Dear Ladies and Gentlemen: On behalf of the above - referenced Petitioner, we are hereby requesting, pursuant to Section 2 -84 of the South Bend Municipal Code, a special exception to the Real Property Tax Abatement Guidelines contained within the South Bend Municipal Code. The exception to the Real Property Tax Abatement Guidelines is requested for the Council to consider Petitioner's application for a ten -year real property tax abatement for a project (the "Project ") that involves mixed use (primarily office and laboratory facilities) facilities that are located in the Northeast Neighborhood Development Area ( "NNDA "). In general, the NNDA is not "pre- designated" as an abatement area. As such, the Project does not fit within the general standards within the South Bend Municipal Code for granting tax abatement for this type of use. . The Petitioner is requesting the special exception for the Project because of the level of benefits set forth in the "Petition for Real Property Tax Abatement Consideration," and the Form SB- 1/Real Property Statement of Benefits previously submitted by the Petitioner to the South Bend Common Council.
