The exception to the
Real Property Tax Abatement Guidelines is requested for the Council to consider Petitioner's
application for a ten -year real property tax abatement for a project (the "Project ") that involves
mixed use (primarily office and laboratory facilities) facilities that are located in the Northeast
Neighborhood Development Area ( "NNDA "). In general, the NNDA is not "pre- designated" as
an abatement area. As such, the Project does not fit within the general standards within the
South Bend Municipal Code for granting tax abatement for this type of use.
. The Petitioner is requesting the special exception for the Project because of the level of
benefits set forth in the "Petition for Real Property Tax Abatement Consideration," and the Form
SB- 1/Real Property Statement of Benefits previously submitted by the Petitioner to the South
Bend Common Council.
Thank you very much for your consideration of this request. If you have any questions,
please feel free to contact us.
PJF:mdm
Enclosures
SBDS02 PFACCENDA 3781380
Sincerely,
Philip J.
