South Bend Fire Department Hazmat & Tactical Team User Fee Ordinance <br />Page 2 <br />Section I. Chapter 9, Article 5 of the South Bend Municipal Code is amended to read in its entirety as <br />follows: <br />ARTICLE 5. HAZARDOUS MATERIALS AND TACTICAL RESCUE TEAM. <br />Sec. 9 -26 Definitions and Hazardous Materials Team User Fees and Costs Established. <br />(a) Definitions: As used in this Article, the following definitions apply: <br />(1) Hazardous materials shall have the definition set forth in Indiana Code § 13- 11 -2 -96, <br />as it may be amended from time to time. <br />(2) Hazardous materials emergency shall have the definition set forth in Indiana Code § <br />13- 11 -2 -97, as it may be amended from time to time. <br />(3) Hazardous substance shall have the definition set forth in Indiana Code § 13 -11 -2- <br />98, as it may be amended from time to time. <br />(4) Hazardous waste shall have the definition set forth in Indiana Code § 13- 11 -2 -99, as <br />it may be amended from time to time. <br />(5) Responsible parry shall have the definition set forth in Indiana Code § 13 -11 -2 -191, <br />as it may be amended from time to time. <br />(6) Responsible person shall have the definition set forth in Indiana Code § 13 -11 -2 -192, <br />as it may be amended from time to time. <br />(b) Hazardous Materials Team User Fees: The following user fee schedule shall be <br />charged by the South Bend Fire Department to the responsible party for all hazardous materials <br />emergencies responses by the department's Hazardous Materials Team in taking emergency action at an <br />address or near the scene of a hazardous materials emergency involving hazardous materials, hazardous <br />substances, and /or hazardous waste: <br />(1) Basic fee (For up to a Maximum four (4) hours) ........... $3,000.00 <br />(2) Additional per hour charge (after four (4) hours) ...............$ 825.00 <br />(3) Computation of the time set for above shall include any fraction of an hour and shall <br />run from the time of dispatch to the time the Hazardous Materials Team reports back in <br />service. <br />Emergency responses and cleanup for spills of gasoline, diesel fuel, waste oil or other engine fluids at <br />gasoline stations shall be charged to the party requesting a response.
