Commonly known as <br />Kensington Farms Subdivision <br />Third Section, Part 2 <br />ORDINANCE NO. 5355 -71 <br />AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE <br />CITY OF SOUTH BEND, INDIANA - 1962 SECTION 40 AS <br />AMENDED, AND GENERAL ORDINANCE NO. 4990 -68, AND <br />THE ACCOMPANYING MAP THERETO, GENERALLY KNOWN AS <br />THE SOUTH BEND ZONING ORDINANCE BY CHANGING THE <br />CLASSIFICATION OF THE USE DISTRICT FOR A CERTAIN <br />PARCEL OF LAND. <br />BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AS FOLLOWS: <br />SECTION 1 <br />The Municipal Code of the City of South Bend, Indiana, 1962, <br />and General Ordinance No. 4990 -68 and the accompanying map or maps <br />thereto, as amended, are further amended insofar as the same relate <br />to that certain parcel of land situate in the City of South Bend, <br />and known and designated as: <br />Beginning at the intersection of the centerline of York <br />Road and the north line of Section 6, Township 36 North, <br />Range 3 East (a point on the present City Limits line); <br />thence south 250 feet; thence west 1680 feet, more or <br />less, to a point on the present City Limits line; thence <br />northerly 290 feet along the present City Limits line to <br />the southwest corner of Lot 67 in Kensington Farms Sub- <br />division, Section 3, Part 2; thence northerly and easterly <br />and southerly along the present City Limits line (which <br />line is also the boundary line of Kensington Farms Sub- <br />division, Section 3, Part 2) to the southeast corner of <br />Lot 77 in Kensington Farms Subdivision, Section 3, Part 2; <br />thence south 40 feet along the present City Limits line <br />to the south line of Section 31, Township 37 North, Range <br />3 East; thence east along the south line of Section 31, <br />Township 37 North, Range 3 East (which section line is also <br />the present City Limits line) a distance of 927 feet, more <br />or less, to the place of beginning, containing 29.4 acres, <br />all in the southwest quarter of Section 31, Township 37 <br />North, Range 3 East and the northwest quarter of Section 6, <br />Township 36 North, Range 3 East, Centre Township, St.ioseph <br />County, Indiana, <br />excepting all legal highways and right of ways, <br />by changing the classification of the "Use District" from "Unzoned" <br />to "A" Residential and from "No" Height and Area District to "A" <br />Height and Area District. <br />SECTION 2 <br />This ordinance <br />the effective date <br />tract, and <br />1st & 2nd READING .9 -27 -71 <br />COMMITTEE OF THE WHOLE <br />PUBLIC HEARING 11 -8 -71 <br />3rd READING 11 -8 -71 <br />NOT APPROVED <br />REFERRED <br />PASSED 11 -8 -71 <br />shall be in full force and effect from and after <br />of the annexation ordinance covering the subject <br />FILED IN CLERK'S OFFICE <br />SEP 2 31971 <br />KATHRYN L.
