including engineering, architectural, appraisal, abstracting, title insurance, <br />and legal fees, and the expenses and legal fees on account of the issuance of <br />bonds therefor in the approximate amount of One Million Six Hundred Thirty <br />Thousand Dollars ($1, 630, 000); and <br />WHEREAS, the Board of Public Works and Safety has filed a <br />request for an appropriation in the amount of One Million Six Hundred Thirty <br />Thousand Dollars ($1, 630, 000) for said purposes, which request has been <br />approved by the City Controller with the recommendation that the funds <br />necessary to cover such appropriation be obtained by the issuance and <br />sale of general obligation bonds of the City; and <br />WHEREAS, a petition has been filed under the provisions of The <br />Indiana Code of 1971, Title 6, Article 1, Chapter 46, by more than fifty (50) <br />owners of taxable real estate in the City of South Bend, Indiana requesting <br />the Common Council to issue bonds in an amount not exceeding One Million <br />Six Hundred Thirty Thousand Dollars ($1, 630, 000) for the purpose of <br />procuring funds to be applied on the cost of the projects hereinbefore <br />described; and <br />WHEREAS, the Council now finds that an extraordinary emergency <br />exists for the expenditure of more money than was set out in detail in the <br />published budget and that the said improvements, acquisitions, developments, <br />construction and equipment are necessary in order to protect the well -being <br />and the property of its citizens and will be of general benefit to the entire <br />City and its citizens; and <br />WHEREAS, the Council now finds that the City has no funds <br />available or provided for in the existing budgets and tax levies which may <br />be applied on said projects, making it necessary to authorize the issuance <br />of bonds of the City in order to procure such funds, and that an extra- <br />ordinary emergency exists for the making of the additional appropriation <br />-2- <br />
