<br />AN ORDINANCE CONFIRMING A CERTAIN RESOLUTION
<br />ADOPTED BY THE BOARD OF PARK COMMISSIONERS AND
<br />THE PUBLIC RECREATION COMMISSION FOR THE CITY OF
<br />SOUTH BEND, INDIANA, DEFINING THE CONSTRUCTION
<br />AND SCOPE, PHOHIBITING CERTAIN ACTS AND ACTIVITIES,
<br />REGULATING USES IN THE PARKS, REGULATING AND
<br />RESTRICTING VEHICULAR TRAFFIC, PROTECTING PLANTS
<br />AND SHRUBS, PROVIDING FOR PENALTIES, REPEALING
<br />ALL ORDINANCES IN CONFLICT AND PROVIDING FOR AN
<br />EFFECTIVE DATE.
<br />WHEREAS, by resolution duly adopted, the Board of Park Commissioners and
<br />the Public Recreation Commission of the City of South Bend, Indiana, prohibited
<br />certain acts and conduct within the property of the City of South Bend under the
<br />jurisdiction of said Board of Park Commissioners and the Public Recreation Com-
<br />mission.
<br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
<br />South Bend, Indiana:
<br />SECTION I. Chapter 4 of the Municipal Code of the City of South Bend,
<br />Indiana is hereby amended, by adding an additional article thereto to read as
<br />follows:
<br />ARTICLE 8. PUBLIC PARKS.
<br />Sec. 4-42. Definitions.
<br />Unless otherwise expressly stated, whenever used in this Ordinance the following
<br />terms shall respectively mean and include each of the meanings set forth:
<br />(a) "BOARD ": The word BOARD, shall mean the Board of Park Commissioners of the
<br />City of South Bend, Indiana or the Public Recreation Commission of the City of
<br />South Bend, Indiana.
<br />(b) "CITY ": The word CITY, shall mean the City of South Bend, Indiana.
<br />(c) "PARK ": The term PARK, unless specifically limited, shall be deemed to in-
<br />clude all parks, parkways, playgrounds, athletic fields, tennis courts, golf courses,
<br />swimming pools, beaches, parking areas, and other recreation areas, museums, zoo-
<br />logical and botanical gardens, places, squares, circles, spurs, open places, boule-
<br />vards, tree lawn areas, roads, waters and lands under water, and also entrances and
<br />approaches thereto, docks and piers, channels and bridges, in, leading to, or
<br />connecting, such park or parks or parts thereof, which are under the jurisdiction of
<br />the Board and such other rights and appurtenances as the Board shall utilize whether
<br />the same be now or hereafter owned or acquired by the City in fee or otherwise, in-
<br />cluding all land under and space above the ground.
<br />(d) "PARKWAY" as used herein shall include only such area as may lie within or
<br />between two public streets.
<br />(e) "PARK- STREET ": The word PARK - STREET shall mean and include all street proper-
<br />ty in the park for the full width thereof.
<br />(f) "RULES AND REGULATIONS: RULES and REGULATIONiS, shall mean and include any
<br />rule or regulation of the Board.
<br />(g) "PERMIT ": PERMIT shall mean and include any written authorization issued
<br />by or under the authority of the Board for a specified park privilege, activity,
<br />or event, or permitting the performance of a specified act or acts in any Park or
<br />Park - Street.
