ORDINANCE NO. 5592 -73 <br />AN ORDINANCE REQUIRING CERTAIN CITY DEPARTMENTS <br />TO SUBMIT BUDGETS TO COMMON COUNCIL. <br />WHEREAS, certain bureaus of the Department of Public <br />Works presently are not required to submit budgets to the Common <br />Council for its approval; and <br />WHEREAS, the Common Council desires that said bureaus <br />shall annually submit budgets to the Council for its approval, <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council <br />of the City of South Bend as follows: <br />SECTION 1. It shall be the duty of the City Controller <br />(Director o the e Department of Administration and Finance) to <br />annually prepare budgets for the next succeeding calendar year for <br />the following bureaus of the Department of Public Works: <br />1. Bureau of Municipal Parking <br />2. Bureau of Sewers <br />3. Bureau of Solid Waste <br />4. Bureau of Water Supply <br />5. Bureau of Wastewater <br />SECTION 2. Said budgets shall be presented to the Mayor <br />for his recommendations. The budgets shall then be presented to the <br />Common Council in ordinance form, making appropriations by items <br />for the use of said bureaus and estimates of the revenue to be <br />received by said bureaus, if any, and a statement of the revenues <br />received in the last complete calendar year, if any. <br />SECTION 3. The budgets shall be on a calendar -year <br />basis and shall be submitted to the Common Council on or before <br />November 1 of the preceding year. The Council shall act promptly <br />on said budgets and shall pass the budgets on or before the last <br />day of November of the preceding year. <br />In the event the Council does not act on or before the <br />last day of November, then the budgets previously passed by the <br />�- Council shall remain in effect. <br />The Council shall have the power to reduce said budgets <br />but may not increase them unless recommended by the Mayor. <br />SECTION 4. Any person violating this ordinance shall <br />be guilty 01 a misdemeanor and shall be subject to imprisonment <br />in the County Jail for a period not in excess of six (6) months, <br />or be subject to a fine not in excess of Five Hundred and 00 /100 <br />..� Dollars ($500.00), or both, and said person may be subject to <br />removal from office. <br />SECTION 5. This ordinance shall be in full force and <br />effect from and after its passage by the Common Council, approval <br />by the Mayor and legal publication. <br />
