ORDINANCE NO. S S 7 8 -7,3 <br />AN ORDINANCE FOR THE TRANSFER OF FUNDS IN THE <br />AMOUNT OF $16,524.17 FROM THE LOCAL ROAD AND <br />STREET FUND PROJECT R & S 40 - WIDENING OF IRELAND <br />ROAD FROM MICHIGAN STREET TO MIAMI ROAD AND <br />$5,508.05 FROM THE CUMULATIVE CAPITAL IMPROVEMENT <br />FUND TO PROJECT R & S 51 - SAMPLE STREET WIDENING <br />FROM MAYFLOWER ROAD TO GREENVIEW AVENUE. <br />WHEREAS, there was enacted during the 1969 session of <br />the Indiana General Assembly an Act, Chapter 392 of the Acts of <br />1969, making available to cities, towns and counties for engineer- <br />ing, construction or reconstruction of roads, streets and bridges <br />under local jurisdiction, certain additional funds to be derived <br />from the 7th and 8th cents of Indiana motor fuel tax and fuel use <br />tax and from increases in fees levied under the Motor Vehicle Act; <br />and <br />WHEREAS, no appropriation of such funds was included in <br />the regular 1973 budget for the Civil City of South Bend, Indiana; <br />and <br />WHEREAS, an emergency exists requiring the appropriation <br />and expenditure of certain of said funds already received or to be <br />received before the end of the year 1973; and <br />WHEREAS, funds have been appropriated for the City's <br />matching funds; and <br />WHEREAS, certain extraordinary conditions have developed <br />so that it is now necessary to appropriate additional funds to <br />Project R & S 51 which was under - funded - Sample Street widening <br />from Mayflower Road to Greenview Avenue, to meet expenses; and <br />WHEREAS, a surplus exists in Account R & S 40, which has <br />been completed - Widening of Ireland Road from Michigan Street to <br />Miami Road and in the Cumulative Capital Improvement Fund. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of <br />the City of South Bend, Indiana: <br />SECTION I.
