ORDINANCE NO. 5s *7,2-?O <br />AN ORDINANCE AMENDING CHAPTER 5, ANIMALS, OF <br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA. <br />BE IT ORDAINED by the Common Council of the City of <br />South Bend, Indiana: <br />SECTION I. Article 2 of Chapter 5 of the Municipal <br />Code of the City of South Bend, Indiana, is hereby amended to <br />read as follows, to -wit: <br />55 -16 Running at large; biting persons; impounding. <br />(A) No person owning or having charge, care, custody, or <br />control of any dog shall cause, permit or allow the <br />dog to be or to run at large upon any street, alley <br />or other public place or upon any private property <br />or premises other than those of the person owning <br />or having charge, care, custody, or control of such <br />dog within the City unless such dog is restrained <br />by a substantial chain or leash and is in charge <br />and control of a competent person. <br />(B) Any dog found or reported running at large in violation <br />of this Section shall be taken up and impounded and <br />will not be released except upon approval of the Chief <br />of Police or his designate and proof that the owner <br />has complied with all applicable state and local laws <br />concerning licensing, inoculation and regulations of such <br />animals. If upon release, the dog is again found or <br />reported running at large in violation of this Section, <br />the dog may be impounded and destroyed and /or the owner <br />may be fined up to $300 fine or jailed up to six (6) <br />months. <br />(C) Any dog running at large which bites a human being shall <br />immediately be impounded as provided in paragraph (B) <br />of this Section, and placed under observation for a <br />period of two (2) weeks at the expense of the owner. If <br />after expiration of the two week observation period, the <br />dog has shown no signs of rabies or other disease, such <br />dog may be released to its lawful owner in accordance <br />with paragraph (B) of this Section. The Chief of Police <br />or his designate shall be empowered to go onto private <br />property for the purpose of impounding such dogs, and <br />to obtain all necessary legal process to accomplish this <br />purpose. <br />SECTION II.
