Kopczynski, Frank Horvath <br />Re: Additional Deputy. <br />The Police Department has had a full time attorney during the <br />past year who has provided advice and assistance to them in <br />matters of criminal and civil law. This attorney will not be <br />there in 1974. <br />I would like to hire a part time deputy to continue this work. <br />He would work under my supervision. I would intend that he meet <br />on a weekly basis with groups of officers to advise them in the <br />areas of arrests, search and seizure, interrogation, evidence, <br />etc. <br />All of these areas are concerned with criminal law but civil <br />law is also involved. If an arrest is improper or if excessive <br />force is used, the City of South Bend can be liable. <br />A good attorney can save the City a serious lawsuit by timely <br />advice to the police. He also could assist in the effort to <br />reduce crime by telling the police what they can do in order to <br />make a good arrest which will result in a conviction. <br />For these reasons, I recommend that this attorney be hired. <br />Ca es A.
