this Indenture, as well as ;Just and reasonable compensation for the services <br />of the Trustee. <br />B. Second, to the payment of the amounts then due and unpaid upon <br />the Bonds and any i.nte-rest due thereon with respect to which monies shall have <br />been collected, ratably and without preference or priority of any kind, according <br />to the ;mounts due and payable upon such Fonds and the interest clue, respectively. <br />Said payment shall be made upon presentation of the several Bonds and the standing <br />of payments tharesn if partly paid and upon the surrender and cancellation thereof, <br />if fully paid. <br />C. Fou_;h, to the payment of any surplus, if any, to the City and /or. <br />Commission and /or the Lessee, their successors or assigns, or to whomsoever <br />shall be lawfully entitled to receive the same. <br />Section 7.10: No recourse under or upon any obligation, covenant, stipulation, <br />or agreement contained in this Indenture, or the Lease or any Bond or any mortgage <br />created hereunder, because of the creation of any indebtedness hereby authorized, <br />shall be had against any member., officer, or director of the Commission, or <br />of any successor to such Commission, or any officer or employee of the City, <br />unless provided for by statutes in the State of Indiana) and the rights and <br />duties of the Bondholders concerning the application of the collateral property <br />herein mortgaged shall be limited to the provisions of the Bond and the mortgages <br />and this Indenture with reference to the liability of the property only for <br />the payment of the Bonds, it being intended hereby to establish the fact that <br />the Revenue Bonds are not general obligations of the City or the Commission, <br />being a department of the City.
