E. <br />Director, Public Works <br />Members of the Common Council <br />County /City Building <br />South Bend, IN 46601 <br />Subject: 1975 Vehicles <br />Gentlemen: <br />Reply To: Department <br />of Public Works <br />October 4, 1974 <br />All vehicles purchased by the City which are 1975 or later models, <br />in accordance with current Federal Law and Regulation, must use non- <br />leaded gasoline. It is our understanding that it is illegal to modify <br />these cars to use leaded gasoline. <br />This matter has been checked with Mr. Ralph J. Kuchle, Service <br />Manager of the Chevrolet Motor Division in South Bend. He stated <br />that as far as he knew it was unlawful to modify the 1975 models <br />to use leaded fuel. <br />We also checked the Federal Clean Air Act as amended June 24, 1974. <br />This Federal statute explicitly forbids manufacturers or dealers from <br />making any such modifications. (See Clean Air Act, Section 203 (a), <br />Paragraph 3.) The Indiana State Law, however, goes even further and <br />states, "except as permitted or authorized by law, no person shall fail <br />to maintain in good working order or remove, dismantle or otherwise <br />cause to be inoperative any air pollution control system or mechanism <br />which is used solely to control air pollution of a motor vehicle..." <br />(Chapter 357, Acts of 1969 of the General Assembly of the State of <br />Indiana, Section 4b (b). <br />Attached are specific citations and penalties for non - compliance for <br />your information. <br />
