ORDINANCE NO. 888 - iS <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND CREATING A BOARD OF <br />MANAGERS TO BE KNOWN AS THE SOUTH BEND <br />CIVIC CENTER BOARD OF MANAGERS <br />......................... <br />WHEREAS, the City of South.Bend, Indiana (hereinafter <br />referred to as the "City "), pursuant to the recently enacted <br />provisions of Indiana Code 1971, 19- 7- 18.5,1, has entered into <br />an agreement for the construction and equipping of facilities <br />to be used as a civic center (hereinafter referred to as the <br />"Civic Center ") ; and <br />WHEREAS, the City, pursuant to said provisions of <br />Indiana Code 1971, 19-7- 18.5 -.1, has the authority to create, by <br />the adoption of an appropriate ordinance, a board of managers <br />for the purpose of supervising, managing, operating and main- <br />taining the Civic Center and its programs; and <br />WHEREAS, it is deemed to be in the best interests of <br />the City to establish such a board of managers for the super- <br />vising, managing, operating and maintaining of the Civic Center <br />and its programs. <br />BE IT NOW, THEREFORE, AND IT IS HEREBY ORDAINED by the <br />Common Council of the City of South Bend, Indiana that; <br />SECTION I. There is hereby created pursuant to the <br />provisions of the Indiana Code 1971, 19,7- .18.5 -1, a board of <br />managers for the purpose of supervising, managing, operating <br />and maintaining the Civic Center and its programs. <br />SECTION II. Such board of managers created herein <br />shall be known as the "South Bend Civic Center Board of Managers". <br />SECTION III. Upon the appointment of members to, and <br />the assumption of duties by_, the South Bend Civic Center Board <br />of Managers as provided herein, Ordinance No. 5504. --73, passed <br />by the Common Council of the City on April 9, 1973, and approved <br />and signed by the Mayor of the City on April 13, 1973, shall be <br />repealed. <br />SECTION IV.
