LEASE <br />THIS LEASE ( "Lease ") is made by and between the City of South Bend, Indiana Department of <br />Redevelopment, actinv by and through the South Bend Redevelopment Commission (the "Landlord ") and Irish <br />Cupcakes. Inc. d/b /a Yummy Cupcakes, (the "Tenant ") as of the date of last execution hereof by Landlord or Tenant <br />(the "Effective Date "). <br />WITNESSETH: <br />ARTICLE I. <br />BASIC LEASE PROVISIONS <br />1.1. Basic Lease Provisions. The following basic provisions of this Lease (the `Basic Lease <br />Provisions" I constitute an integral part of this Lease and are set forth in this Section 1.1 for the convenience of the <br />parties. Each reference in this Lease to a Basic Lease Provision shall be construed to incorporate all of the terms <br />provided for under such provisions. <br />(a) Leased Premises: <br />119 S. Michigan Street and as further defined in Section <br />2_1 hereof, consisting of approximately 1,200 square <br />feet of "Floor Area." <br />(b) Term <br />Initial Term of Five (5) Lease Years, as provided for in <br />Sections 3.1 and 3_2 hereof with Two (2), Five (5) year <br />renewal options. <br />(c) Tenant's Use: <br />The premises shall be used solely for the operation of a <br />Yummy Cupcakes Bakery. <br />(d) Tenant's Trade Name: <br />Yummy Cupcakes (or such other trade name taken by <br />the Tenant) <br />(e) Landlord's Address: <br />1400 County-City Building <br />227 West Jefferson Boulevard <br />South Bend, Indiana 46601 <br />(f) Tenant's Address: <br />Attn: Mr. Lawrence Katz <br />58727 Baugo Cove Dr. <br />Elkhart, IN 46517 <br />(g) Lease Year: <br />A "Lease Year" shall mean each period of twelve (12) <br />consecutive full months, beginning on the <br />Commencement Date as defined in Section 3.1 (such <br />that if the Commencement Date is not the first day of a <br />calendar month, then the first Lease Year shall begin on <br />the first day of the first calendar month following the <br />Commencement Date, and any partial month in which <br />the Commencement Date occurs will be included within <br />the first Lease Year). <br />(h) Security Deposit' <br />An amount equal to the first month's Modified Gross <br />Rent as security deposit shall be due upon signing of <br />lease.$800.00 <br />(i) The Buildine: <br />Michigan Street Shops, commonly referred to as 117 — <br />131 S.
