ORDINANCE NO. 5957 -76 <br />AN ORDINANCE AMENDING CHAPTER 16, ARTICLE <br />2 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH <br />BEND, INDIANA PERTAINING TO THE RULES AND <br />REGULATIONS OF THE BOARD OF PUBLIC WORKS AND <br />THE ADDITION OF AUTHORIZING THE TAKING OF <br />COMPETITIVE BIDS FOR INSURANCE COVERAGE OF <br />THE CITY. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council <br />of the City of South Bend, as follows: <br />SECTION I. The following section of the Municipal <br />Code of the City of South Bend, Indiana, shall be amended to read as fol- <br />lows: <br />SEC. 16 -2 A. Board of Public Works; rules and regula- <br />tions. 2 <br />(a) The Board of Public Works shall promulgate such <br />rules and regulations as may be necessary to carry into effect the operation <br />and intent of this Chapter. <br />(b) The Board shall promulgate such rules and regula- <br />tions as may be necessary to carry into effect the operation and intent of <br />the powers and duties mandated by State law. <br />SEC. 16 -2 B. Board of Public Works; purchase of all <br />city insurance by competitive bids. <br />(a) The Board of Public Works shall have the authority <br />to purchase such insurance to cover the liability of the city as may be neces- <br />sary to carry out the provisions and intent of this Chapter. <br />(b) All contracts for insurance coverage shall be sub- <br />ject to competitive bidding. <br />(c) Complete specifications for such insurance shall <br />be approved by a committee whose members shall include the City Attorney, <br />Controller, Deputy Controller, and Chairman of the Common Council's Com- <br />mittee on Administration and Finance. Specifications shall be filed with <br />the Clerk to the Board. <br />(d) The Board shall cause to be published for two (2) <br />weeks, once each week, in a newspaper of general circulation published in <br />the city, a notice informing the public and prospective bidders of the <br />general nature of the insurance coverage needed and of the facts that com- <br />plete specifications are on file in such office, and calling for sealed <br />proposals for such coverage by a day not earlier than one hundred twenty <br />(120) days after the last of such publications. <br />(e) The Board shall require each bidder to file with <br />such Board an affidavit that such bidder has not directly or indirectly <br />entered into any combination, collusion, undertaking or agreement with any <br />other bidder or other person with reference to such bidding, in any way or <br />manner whatever. <br />(f) Upon proper money appropriation by ordinance, the <br />Board shall, if a satisfactory bid be received, let such contract to the <br />lowest or best bidder. <br />
