CITY CLERK, SOUTH BEND, <br />South Bend, Indiana 46601 IND. <br />Re: ORDINANCE NO. 5991 -76 <br />AN ORDINANCE FIXING THE ANNUAL PAY OF <br />POLICEMEN FOR THE CALENDAR YEAR 1977 <br />Dear Mr. Parent: <br />At the Public Hearing on the above Ordinance on Monday, July 19, 1976 <br />a number of amendments were made. At one point in the proceedings <br />Councilwoman Adams moved to amend Section 2 of the Ordinance. As you <br />recall, that is the suggested amendment that gave minimum wage increases <br />to police officers. Along with the defeat of the amendment went two <br />other proposed changes which we think are important and significant. <br />As you recall, when we negotiated the wage ordinance we were particularly <br />interested in making sure that no officer received less money in the <br />year of 1977 than he received in 1976. Section 2 of the ordinance makes <br />reference to that understanding but I feel that it is unintentionally <br />restrictive because of the inclusion of two words in that section. The <br />word "based" found in line 2 of Section 2 of the ordinance should be <br />stricken. As you know, it was intended that the net pay of the officer <br />be the amount for comparison to make sure that he does not take a cut in <br />pay. Then, in that same section, in the second to the last line the <br />word "may" should be changed to shall. <br />Pursuant to the Council and our understanding of the intended ordinance <br />I have attached a draft of a proposed ordinance which we would ask you <br />take up at the Council meeting on July 26, 1976 reflecting the changes <br />which I have set forth-in the above paragraph. Hopefully, the Council <br />will see fit to make the changes which are suggested in the attached <br />proposal so that we do not encounter difficulty in the administration <br />of the pay ordinance. <br />If you have questions or if I can be of further assistance please <br />contact me. <br />V r� y truly yours. <br />GEH:pec GEORGE E.
