REGULAR MEETING AUGUST 12, 2013 <br /> <br /> <br /> <br /> <br />Ms. DeRose advised that during the 2013 session of the Indiana General Assembly, the State <br />penalty for infractions related to parking unlawfully in spaces reserved for persons with a <br />physical disability was increased from $50.00 to $100.00, effective, July 1, 2013. By State <br />statute (IC 5-16-9-9(b)), any local law which regulates such parking, as South Bend does, must <br />be consistent with State law. <br /> <br /> This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />The following individual spoke in favor of this bill: <br /> <br />Sam Brown, 415 LaSalle, South Bend, Indiana, asked what happens when a handicapped spot <br />that was designated on a residential street for a disable person and that person dies. <br /> <br />Ms. DeRose stated that they would like to be informed of cases like that. She stated that if a <br />designated handicapped spot is not needed please inform the Department of Public Works to <br />have that location and sign removed. <br /> <br />There being no one else present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Dieter made a motion for favorable recommendation to <br />full Council concerning this bill. Councilmember Oliver Davis seconded the motion which <br />carried by a voice vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 33-13 PUBLIC HEARING ON A BILL OF THE COMMON <br /> COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br /> FOR BUDGET TRANSFERS FOR VARIOUS <br /> DEPARTMENTS WITHIN THE CITY OF SOUTH <br /> BEND, INDIANA FOR THE YEAR 2013 <br /> <br />Councilmember Dieter made a motion to continue this bill until the August 26, 2013 meeting of <br />the Council.
