REGULAR MEETING AUGUST 12, 2013 <br /> <br /> <br /> <br /> <br />SECTION II. The Board of Public Work’s sale of real estate located at 4224 Fellows Street, <br />South Bend, St. Joseph County, Indiana, which is more particularly described as <br /> <br />Lot Numbered 3 in Parkside Terrace Minor Subdivision as per plat thereof recorded March 4, <br />1981, as Instrument Number 8103327, in the Office of the Recorder of St. Joseph County, <br />Indiana; is approved at a price of not less than the appraised value and in accordance with the <br />provisions of Indiana Code Section 36-1-11-4.2 and pursuant to Board of Public Works <br />Resolution No. 41-2013 dated July 9, 2013. <br /> <br />SECTION III. In its sale of the subject real estate, the Board of Public Works shall comply fully <br />with the terms and conditions of Indiana Code Section 36-1-11-4.2. <br /> <br />SECTION IV. This Resolution shall be effective from and after its passage by the Common <br />Council. <br /> <br />th <br />Passed and Adopted by the Common Council of the City of South Bend, Indiana, this 12 day of <br />August, 2013. <br /> <br /> s/Derek D. Dieter <br /> Member of the Common Council <br /> <br />Councilmember Schey, Vice-Chairperson, Public Works and Property Vacation Committee, <br />reported that this committee held a Public Hearing on this bill this afternoon and voted to send it <br />to the full Council with a favorable recommendation. <br /> <br />th <br />Aladean DeRose, Assistant City Attorney, 12 Floor County-City Building, 227 W. Jefferson <br />Blvd., South Bend, Indiana, made the presentation for this bill. <br /> <br />Ms. DeRose advised that this Resolution is to approve the sale of real estate located at 4212 <br />Fellows Street and 4224 Fellows Street. She stated that on July 9, 2013 the Board of Public <br />Works conducted a public hearing concerning the sale of these two properties. She noted that <br />the sale of this real estate must be approved by the Mayor and the Common Council. Upon <br />approval the property will be sold for no less than the appraised value of the property. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />Councilmember Henry Davis asked what the assessed value is. <br /> <br />Ms. DeRose stated over $100,000 each, approximately $250,000 for the two combined. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this Resolution. Councilmember Schey made a motion to adopt this Resolution as substituted. <br />Councilmember Dieter seconded the motion which carried and the Resolution was adopted by a <br />roll call vote of nine (9) ayes. <br /> <br />BILLS - FIRST READING <br /> <br /> <br />BILL NO. 36-13 FIRST READING ON A BILL TO VACATE THE <br /> FOLLOWING DESCRIBED PROPERTY: A PORTION <br /> OF HARTMAN DRIVE FROM OAK RIDGE DRIVE <br /> EAST TO THE EAST PROPERTY LIMITS OF LOTS 87 <br /> & 88 WOODED ESTATES <br /> <br />This bill had first reading. Councilmember Scott made a motion to refer this bill to the Public <br />Works and Property Vacation Committee and set it for Public Hearing and Third Reading on <br />September 9, 2013.
