Approval is subject to the Petitioner complying with the reasonable conditions <br />established by the Area Board of Zoning Appeals which are on file in the office of the City <br />Clerk; and is subject to the written commitments filed with the Office of the City Clerk after they <br />have been duly executed. <br /> <br />SECTION V. The Resolution shall be in full force and effect from and after its adoption by the <br />Common Council. <br /> <br />Councilmember Dr. Fred Ferlic, Chairperson, Zoning & Annexation Committee, reported that <br />this committee held a Public Hearing on this bill this afternoon and voted to send it to full <br />Council with a favorable recommendation. <br /> <br />Mark Lyons, Assistant Zoning Administrator, Building Department, Suite 100, 125 S. Lafayette <br />Blvd., South Bend, Indiana, presented the report from the Area Board of Zoning Appeals. <br /> <br />Mr. Lyons advised that the petitioner is seeking a special exception to allow a crematory in a <br />“LI” District on property located at 1731 S. Franklin St., South Bend, Indiana. He stated that <br />Board of Zoning Appeal held a public hearing on August 7, 2013 and sends this bill to the <br />Common Council with a favorable recommendation. <br /> <br />Patrick Nowak, 6016 Sutton, South Bend, Indiana, made the presentation for this bill. <br /> <br />Mr. Nowak advised <br /> <br />Council Attorney Kathleen Cekanski-Farrand read the amendment into the record: Section IV. <br />Approval is subject to the Petitioner complying with the reasonable conditions established by the <br />Area Board of Zoning Appeals which are on file in the office of the City Clerk; and is subject to <br />the written commitments filed with the Office of the City Clerk after they have been duly <br />executed. <br /> <br />A Public Hearing was held on the Resolution at this time. <br /> <br />The following individuals spoke in favor of this bill: <br /> <br />Aaron Nowak, 5627 Danbury, South Bend, Indiana, stated that he is in favor of this business <br />expanded. Mr. Nowak advised that businesses expanding in South Bend is a good thing. He <br />urged the Council’s favorable consideration. <br /> <br />Jesse Davis, P. O. Box 10205, South Bend, Indiana, spoke in favor of this bill. Mr. Davis <br />advised that cremation is cost efficient. He stated that after losing his brother and there were no <br />death benefits to bury him, they chose cremation. He asked the Council for their favorable <br />adoption. <br /> <br />Marge Dudeck, 1914 Catalpa, South Bend, Indiana, stated that she is in favor of this resolution. <br />Ms. Dudeck stated that neighbors should not be concerned with their children seeing bodies. She <br />noted that parents need to be responsible and explain it. She stated that she would be happy to <br />have this business next to her; she stated that it would be better than what is next to her right <br />now. <br /> <br />Patrick Hahn, 3916 Rosemont, South Bend, Indiana, spoke in favor of this bill. Mr. Hahn stated <br />that they need a crematory in the South Bend/Mishawaka area. He urged the Council to adopt <br />this resolution favorably. <br /> <br />Rose Smorse, 2120 S. Catalpa, South Bend, Indiana, stated that she is in favor of this bill. She <br />stated that she does not believe a business like this will bring down property values in the <br />neighborhood. She stated that it is the vacant and abandoned houses that have done that.
