(2) Alley means a public way, other than a street or public <br />court which affords secondary access to property. <br />(3) Apartment house means a building or portion of a build- <br />ing designed or used as a residence for three (3) or more families or <br />households living independently of each other. <br />(3.1) Associated sphere of influence: The area extending <br />from one -half block beyond the boundaries of the Central Downtown <br />Urban Renewal Project Area and bounded by Marion Street on the north, <br />Williams Street on the west, South Street on the south, and Niles <br />Avenue on the east. <br />(4) Basement means a story having at least half of its <br />height below the finished grade. A basement shall be counted as a <br />story, if subdivided and used for dwelling or business purposes. <br />(5) Block means a length of street from one (1) intersect- <br />ing street to the next intersecting street. The property fronting on <br />a length of street between two (2) streets which join or intersect <br />such length of street. <br />(6) Boardinghouse means a building, other than a hotel, <br />where lodging and means are provided for three (3) or more persons <br />whether or not for compensation. <br />(7) Board means Board of Zoning Appeals. <br />(8) Building or structure means a structure consisting of <br />foundation, walls, floor and roof enclosing space to be occupied. <br />(8.1) Building facade: That portion of any exterior eleva- <br />tion of a building extended from grade to the top of the parapet wall <br />or eaves and the entire width of the building elevation, and which may <br />also be referred to as the "building face." <br />(9) Building, height of, means the vertical district measur- <br />ed from the established street grade to the highest point in the coping <br />of a flat roof, to the deck line of a mansard roof and to the average <br />height between eaves and ridge of a gable, hip or gambrel roof. For <br />buildings set back from the street line, the height of building may be <br />measured from the average elevation of the finished grade along the <br />front of the building, provided its distance from the street line is <br />not less than the height of such grade above established grade. <br />(10) Business means an enterprise involving selling storing <br />or processing goods or commodities or the rendering of services. <br />(11) Business, commercial means a retail business selling <br />to the public. <br />(12) Business, industrial means an enterprise engaged in the <br />manufacture, the processing of materials or the assembling of parts <br />into finished or semifinished products; also the repair or recondition- <br />ing of products, appliances, machines, furniture or other goods which <br />involve manufacturing operations or processes. This class of business <br />may be further subdivided into light industrial or heavy industrial. <br />(13) Certificate of Occupancy means a certificate issued by <br />the Building Department authorizing an occupancy under the Zoning Law. <br />- 2 - <br />
