Jefferson Blvd. <br />South Bend, Indiana 46601 <br />Dear Council Members: <br />219/284-9742 <br />The attached bill would appropriate $40,000.00 from General <br />Revenue Sharing for use in the city's proposed housing repair <br />program. Bill No. 2977 which had its first reading before the <br />Common Council on February 28, 1977, would change the enabling <br />statute under which the City of South Bend currently achieves <br />building code enforcement. That enabling statute provides that <br />a hearing officer may be appointed by the Mayor to hear petitions <br />brought him by the Building Commissioner. Under the new enabling <br />statute the Building Commissioner would have an arry of remedies <br />against homeowners and absentee landlords who allow their prop- <br />erties to deteriorate. Included among these remedies would be <br />possible injunctive relief, civil forfeitures of up to $1,000.00 <br />and the establishment of receiverships. <br />The requested funding would enable the city to make repairs to <br />residences which have been allowed to deteriorate where the home- <br />owner or absentee landlord has failed to make the repairs him- <br />self. When such repairs were made the city would then proceed <br />to collect the cost of rehabilitation from the property owner <br />by means of a personal judgment. <br />This Ordinance is filed in conjunction with the ordinance appro- <br />priating $23,040.00 from the Counter-Cyclical Grant for staff <br />functions. <br />Fete�.ff. muiien <br />Cont ller <br />
