Parker <br />Chief Deputy <br />Members of the Common Council <br />4th Floor Council Chambers <br />County -City Building <br />South Bend, Indiana <br />Dear Council Members: <br />On September 12, 1977 the Common Council approved the <br />Fifth Amendment to the contract originally entered into between <br />Clay Utilities, Inc. and the City of South Bend on March 22, <br />1965. This amendment provided that if certain lease - purchase <br />agreements between the City and Clay were executed, the City <br />would purchase from Clay the water pumping facilities commonly <br />referred to as Aqua, Inc. at a purchase price of $92,985.00. <br />This purchase should now be completed and the attached ordinance <br />provides for an appropriation of funds from the Water Works <br />Depreciation fund into the Water Works budget item for buildings, <br />structures and improvements. <br />Sincerely, <br />Robert arker <br />Chief Deputy City Attorney <br />RMP:az <br />
