ORDINANCE NO. 6255 -77 AN ORDINANCE AMENDING CHAPTER 14.5, ARTICLE I, SECTION 14.5 -3 ENTITLED LEASE OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes that city -owned real property should be used to its greatest economic benefit. The Council further recognizes that the authority to protect, maintain, and dispose of such interest in city -owned real property is vested directly in the City. Therefore, in the interest of providing a leasing procedure of city -owned real property which assures fairness and equity, the following bill is introduced. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. SECTION 14.5 -3 of the Municipal Code of the City of South Bend is hereby amended to read in its entirety as follows: SEC. 14.5 -3 Leasing of City -owned Real Property to.Non- governmental Bodies. (a) Any city -owned real property declared to be excess and available for disposition as provided in Section 14.5 -2(a) may be leased by the City. (b) Any lease of city -owned real property shall be in writing and submitted to the appropriate board for its approval.. (c) Upon the board's determination that a fair rental value of such real property has been offered by the proposed lessee and upon approval of said lease, the lease shall be submitted to the Common Council with an appropriate resolution. (d) Upon the adoption of such resolution and approval by the Mayor, such lease shall be in effect between the City as lessor and the lessee. (e) All rents collected shall become a part of the appropriate fund. (f) This section shall apply to all city -owned real property where the proposed lessee is a non - governmental body. SECTION II. This Ordinance shall be in full force and effect from and after its passage by the Common Council, and approval by the Mayor. Passed, as amended, November 14, 1977
