ORDINANCE NO. 6255 -77 <br />AN ORDINANCE AMENDING CHAPTER 14.5, ARTICLE I, <br />SECTION 14.5 -3 ENTITLED LEASE OF THE MUNICIPAL <br />CODE OF THE CITY OF SOUTH BEND, INDIANA. <br />STATEMENT OF PURPOSE AND INTENT <br />The Common Council of the City of South Bend recognizes that <br />city -owned real property should be used to its greatest economic <br />benefit. The Council further recognizes that the authority to <br />protect, maintain, and dispose of such interest in city -owned real <br />property is vested directly in the City. <br />Therefore, in the interest of providing a leasing procedure <br />of city -owned real property which assures fairness and equity, <br />the following bill is introduced. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. SECTION 14.5 -3 of the Municipal Code of the City <br />of South Bend is hereby amended to read in its entirety as follows: <br />SEC. 14.5 -3 Leasing of City -owned Real Property to.Non- <br />governmental Bodies. <br />(a) Any city -owned real property declared to be excess and <br />available for disposition as provided in Section 14.5 -2(a) may be <br />leased by the City. <br />(b) Any lease of city -owned real property shall be in writing <br />and submitted to the appropriate board for its approval.. <br />(c) Upon the board's determination that a fair rental value <br />of such real property has been offered by the proposed lessee and <br />upon approval of said lease, the lease shall be submitted to the <br />Common Council with an appropriate resolution. <br />(d) Upon the adoption of such resolution and approval by the <br />Mayor, such lease shall be in effect between the City as lessor and <br />the lessee. <br />(e) All rents collected shall become a part of the appropriate <br />fund. <br />(f) This section shall apply to all city -owned real property <br />where the proposed lessee is a non - governmental body. <br />SECTION II. This Ordinance shall be in full force and effect <br />from and after its passage by the Common Council, and approval by <br />the Mayor. <br />Passed, as amended, November 14, 1977 <br />
